In 2015, I was visiting Key Largo, when my new/used Subaru Outback began having clutch issues. I towed it to a local mechanic, whom the hotel proprietor suggested. After keeping me there an additional 3 days at $100+ a night, I was charged $1100 for the repair. I asked the man if he had fixed the leakage problem, originally asked when I dropped the car off. He assured me that there was no leakage. I then drove to Key West. On the way back towards Key Largo that evening, all of the oil spewed out of my engine and a cam shaft and cam shaft seal broke. The car was un-drivable. I brought it back to his shop and ended up spending another 4 nights back at the original hotel. After 5 days of his avoidance and not returning my messages or being present when I walked a mile each way to his shop, I had to get a Monroe County deputy and tow truck to remove the vehicle from his property. He had not given me any prior written estimate for either repair, and had disassembled my engine without my permission. Another mechanic, who suggested the obvious collusion between the auto repair guy and the hotel proprietor, allowed me to park the vehicle on his property. I was going to ship it back to NC, but he said that knew a Subaru "specialist" in Miami. I then had the vehicle towed there. This was June 6, 2015; I have yet to get my vehicle back. This "specialist" made excuses, avoided me, and allegedly didn't make the proper repair until 6 months had passed, well into December 2015. At that point in time I was hospitalized, as I am a disabled combat veteran. This gentleman did not give me any estimate, though I requested one as far back as July. Unbeknownst to me, he was charging me $45 a day for storage, in addition to the $3700 repair. When he finally attempted to contact me, he was threatening to put a lien on my title and take my car. By this time, the bill was way over $5000. After he avoided me another 2 weeks, and me taking out an unsecured loan and sending him a $1300 cashiers check as a good faith payment, I asked him to give me a break on the storage, as I could not afford the rate he was charging. He said that he would look at the numbers and that "he would call me." I didn't hear back from him. I spent 2 weeks gathering receipts, writing affidavits, and scanning documents for a Florida attorney who decided not to represent me after doing all that he requested....I guess the case was too small for him. I wrote an email explaining to the Subaru "specialist" that my mother is in Stage4 cancer. I did not wish to pursue this in a court of law. I offered to just deliver the Title to him if he would return my $1300. He never responded to the email, and 4weeks later I received a certified letter from a Florida title lien company. He has kept my money, which is on loan, and my automobile.

I am under the belief that the disrepair from the first dishonest mechanic and his hotel friend, was the initial cause of the second larceny. I believe that I was again victimized by the second set of mechanics, who saw an opportunity to take advantage of somebody not local to the Key Largo / Miami area. In total I have lost $1200+.

I believe that this was intentional from the beginning. First, the disrepair and then the "specialist" intended on taking my vehicle by creating a lengthy and expensive scenario, which he knew I would have difficulty in fulfilling, by putting the balance of his extremely long repair, above my means. It was his intention all along to keep my vehicle. I had only purchased the vehicle, in full, 4 months prior the commencement of this debacle.

I have everything digitized for delivery and the use of qualified FL consumer protection attorney who sees at least 1 case, maybe 2, in this situation. My main concern is to recover my damages, but if there is a possibility of proving mens rea, I would also pursue punitive damages. Both the original mechanic and the "specialist" own their businesses outright and I am willing to be in this for the long haul. I seek relief.
